Terms of service

These terms are the agreement between Kloqk and the business that creates a workspace. By signing up you accept them on behalf of your business. They are written to be read; if something is unclear, ask us at [email protected].

1. What Kloqk is

Kloqk is an employee time clock and HR platform: kiosk and mobile punching, timesheets, overtime and break calculations, scheduling, PTO, reports, payroll exports, and related tools. The core time clock is free for unlimited employees at one location. Pro is $29 per location per month and Premium is $59 per location per month, as described on the pricing page.

2. Your account and your team

  • You are responsible for the accuracy of what your workspace enters and for keeping credentials, kiosk devices, and PINs under your control.
  • Employees you add or invite use Kloqk under your instructions. You are responsible for having the right to enter their information and, where photo verification or location-stamped punching is enabled, for telling your team and meeting any notice or consent rules that apply to you.
  • One person may not use another person's PIN or account to punch. That is what the product exists to prevent.

3. Your data

  • Your business owns the records in your workspace. We process them to run the service, as the privacy policy describes, and for nothing else. We do not sell data.
  • You can export your records at any time, on every plan.
  • If you close your workspace we delete it permanently after a short recovery window. Keeping wage records for the periods the law requires is your obligation; export before you close.

4. Billing

  • Paid plans are billed monthly per location through Stripe, in US dollars, in advance.
  • You can upgrade, downgrade, or cancel from the billing page at any time. Cancelling stops future charges; the paid features run out the month you already paid for. We do not prorate partial months.
  • Prices can change; existing subscriptions get at least 30 days of notice by email before a change applies to them.
  • The free plan is free. It is not a trial and does not expire.

5. Acceptable use

Do not use Kloqk to break the law, to store data you have no right to hold, to probe or disrupt the service, or to build a falsified record of hours worked. We can suspend a workspace that does, and will tell you why.

6. Compliance features are tools, not advice

Kloqk calculates overtime and break premiums under the rules you configure, and the HR law library summarizes public sources with links to the agencies that publish them. None of that is legal advice, and wage and hour rules change. Confirm current requirements with your state labor department or your counsel; you remain responsible for your own compliance and your payroll.

7. Service and support

  • We work to keep Kloqk available and fast, and we maintain backups, but no software is promised to be uninterrupted or error-free.
  • Support by email is included on every plan.
  • We may change or retire features; if a change removes something you pay for, you can cancel and we will refund the unused portion of that month.

8. Liability

To the extent the law allows, Kloqk's total liability for any claim related to the service is capped at the amount your business paid us in the twelve months before the claim, and neither side is liable to the other for indirect or consequential damages. Nothing in these terms limits liability that cannot lawfully be limited.

9. Ending the agreement

You can stop using Kloqk and close your workspace at any time. We can end the agreement for a serious or unremedied breach of these terms, with notice and, except where the breach makes it impossible, time to export your records.

10. The legal frame

These terms are governed by the laws of the State of Texas, and disputes belong to the state or federal courts sitting in Dallas County, Texas. If a court finds part of these terms unenforceable, the rest still stands. When we change these terms in a way that matters, we will update the date above and notify account owners by email; continuing to use Kloqk after notice accepts the change.
