Rajasthan Shops and Commercial Establishments Act, 1958, as amended by Act No. 5 of 2026 (from 17 Dec 2025) · Reviewed 2026-10 · Private-sector employees
Overtime
1.5x the ordinary rate for work over 9 hours a day or 48 hours a week (s.8, unamended). Normal day is now 10 hours; max 144 overtime hours a quarter.
Breaks and lunch
At least 30 minutes of rest after 6 hours of work (s.9). Spread-over max 12 hours (s.10).
Overtime in Rajasthan
- 1.5x pay for hours past 9 in a day.
- 1.5x pay for hours past 48 in a week.
- The 2026 Act raised the normal day to 10 hours (s.7(1)) but did not amend s.8, which still sets overtime at 1.5x beyond 9 hours a day. Rows follow s.8 literally.
- The OSH Code s.27 requires 2x for overtime in establishments with 10+ workers, so paying 2x is the safer choice.
- Max 10 hours a day including overtime except stock-taking and accounts days (s.7(1) proviso, unamended), which leaves no daily overtime room on ordinary days. Overtime cap raised from 50 to 144 hours per quarter.
- One closed day a week and one whole day off per employee without pay deduction (s.12). A June 2026 exemption allows 7-day opening with a paid rotating weekly off, 10 hours a day and 48 a week.
Averaging over a pay period: Not allowed
