2x the ordinary rate for work over 9 hours a day or 48 hours a week (s.6). Max 11 hours a day including overtime and 144 overtime hours a quarter.
Breaks and lunch
At least 30 minutes of rest after no more than 5 hours of continuous work (s.7). Spread-over max 12 hours (s.7).
Overtime in Uttar Pradesh
- 2x pay for hours past 9 in a day.
- 2x pay for hours past 48 in a week.
- Daily limit raised from 8 to 9 hours; young persons max 6 hours (s.6(1)).
- Total including overtime: 11 hours a day, except stock-taking and accounts days. Overtime cap raised from 50 to 144 hours per calendar quarter.
- Ordinary rate = basic plus allowances, excluding bonus; a day counts as 9 hours for the overtime rate (s.6(2)).
- Does not apply to shops or establishments with fewer than 20 employees (s.3(1)(g)); now statewide. Confidential, managerial or supervisory staff (max 10%) and intermittent workers are excluded.
- One close day a week and one whole day off for each employee (ss.8, 9).
